《合建契約書》.doc

立契約書人x x x（以下簡稱甲方），x x x（以下簡稱乙方），茲因合作興建房屋事宜，經雙方協議，同意訂定各條款如下：
    第一條 甲方所有坐落x x x x地號土地一筆，如附圖所示，約x x平方米。愿提供與乙方合作興建房屋。
    第二條 本約甲方所提供的土地雙方協議同意興建四層鋼筋混凝土造和集合住宅，除依法應設置的公私道路用地外，其余可建土地，乙方應依法合理充分利用。
    第三條 本約雙方合作興建房屋，其土地規劃，建筑設計，請領建造執照，營造施工及有關的風險等，均由乙方負責處理并負完全責任，其各類費用亦由乙方負擔，概與甲方無涉。乙方營造施工過程中，甲方得隨時親自派員監督。
    第四條 本約甲乙雙方按附圖所示的擬建房屋為準，采立體分屋方式，由甲方取得百分之x x ，乙方取得百分之x x 。若雙方分取的房屋戶數未能整數時，其間的差額，可經雙方的同意，由取得之一方按協議價格以現金補償對方。
    第五條 本約有關建造設計文件圖說應征求甲方同意，并按前條雙方分配的位置，標明于圖說上，各自具名或指定第三人為起造人，由乙方負責提出申請建造執照。
    第六條 本約興建房屋事宜，均依現行建筑法規辦理，若法規變更而受限制時，則依變更后的法規辦理。
    第七條 凡畸零地及水利地的合并承買等事宜，均由甲方備齊所需證件并由乙方負責辦理。惟
